Terms and Conditions

On booking, it is assumed that clients have read, understood and agreed to the listed conditions of rental.

 

Contract

The contract is for a short-term holiday rental, made between the client and York Holiday Rentals, the property owner’s agent, binding from such time that booking is made and inclusive of all the following conditions. By making a booking the client contracts on behalf of himself/herself and all those in his/her party and represents that he/she has the authority to accept these conditions on behalf of and binding upon all guests in his/her party. Bookings are accepted on
the understanding that the property is taken for holiday purposes only and that, excepting babies, the number of people in each property is limited to that entered on the enquiry / booking form. Any friends or family of the client visiting the property while the client is staying there must adhere to the conditions of the contract, including the rules and procedures.

 

Payment

If the booking is made more than eight weeks before the start of the rental, a deposit (non-refundable in event of cancellation) is payable. Bookings are provisional until a deposit is received. The balance shall be payable four weeks (six weeks in certain high season periods) before the commencement of the rental. If the booking is made less than four weeks before commencement, full payment must be made. Non-payment of the balance after the due date may be construed as a cancellation of the contract by the client.

 

Cancellation

In the event of a late cancellation (within 4 weeks of commencement of the rental) the total cost of the rental is payable. Any cancellation made by the client for whatever reason shall be notified in writing or by e mail. On receipt of the notice of cancellation the owner’s agent will seek to re-let the property for the period of booking. If a re-letting is achieved, the owner’s agent will refund money already paid by the client less the initial deposit and rent for any part of the period which was not able to be re-let and less an administrative charge of £25.00. The client is advised to take out holiday cancellation insurance. The owner’s agent may cancel a booking at any time if a problem arises that makes the rental property unsuitable for occupation and is outside the owner’s or agent’s control. In the event of such an occurrence the owner’s agent will refund to the client all monies paid without any further liability to the agent or owner.

 

Period of Hire

Rentals commence with a check in time of 3.30 pm on the day of arrival and terminate with a check out time of 10.00am on the day of departure (12 Noon on Sundays if the booking is a 2 night weekend rental).


Right of Entry

Whilst respecting the reasonable privacy of the client, the owners reserve the right to access all properties at all times, if necessary, for repairs and emergencies.


Occupancy

The client must not use the accommodation or allow its use for any dangerous, offensive, noisy, illegal or immoral activities or behave in any way that may be a nuisance or annoyance to any neighbours.

 

Care of the Property

The client shall take all reasonable and proper care of the property and its furniture, fittings and effects in or on the property and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period.


Breakages or Damage

The client is required to inform the owner of any damage or breakage in or around the property promptly, during the course of the rental period, so that it can be repaired or replaced for the next guests. The client is bound to reimburse the owners for replacement, repair or extra cleaning costs where reasonably demanded by the owner or agent for damage caused by the client.
No charge is made for minor breakages to such items as glasses, crockery etc.


Complaints

Clients must contact the owner’s agent with any problems or complaints during the course of their stay to allow the owner’s agent time to deal with the complaint and where necessary rectify the problem.
No complaints will be dealt with after the period of the rental when the client has checked out of the property.


Smoking

Smoking is not permitted anywhere inside the holiday accommodation.


Pets

No pets are permitted in the property.

 

Liability

Neither the owner or their agent is liable for any loss or damage to any client's property, or any property belonging to a member of the client's party, howsoever caused. The client or members of his/her party cannot hold the owners of the property or their agent liable for any personal injury/death howsoever sustained where the owners and/or their agent have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.
